PRIVACY POLICY

Glenskye Pty Ltd ACN 010 389 081 as trustee for the Gatton Real Estate Unit Trust trading as Gatton Real Estate (GRE) is committed to managing personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act) and in accordance with other applicable privacy laws.

PURPOSE

This Privacy Policy sets out:

  1. how we collect and hold your Personal Information;
  2. the kinds of Personal Information we may collect and hold;
  3. the purposes for why we collect, hold, use and disclose personal information;
  4. how you can make complaints and seek access to your Personal Information;
  5. whether we are likely to disclose your Personal Information to an overseas recipient and if so, in what countries we are likely to disclose your information to; and
  6. how you can contact us if you have any privacy concerns about your Personal Information.

As we operate a residential tenancy database, we are bound by the APP’s contained in the Privacy Act.

SCOPE

This policy applies to all clients, prospective clients, employees, prospective employees, contractors, visitors other individuals that may come into contact with GRE in relation to real estate services including but not limited to property sales or purchases and tenancy related dealings including property management or leasing.

DEFINITIONS

In this Privacy Policy, unless, the context otherwise requires:

  1. Permitted General Situation means:
    • lessening or preventing a serious threat to the life, health or safety of any individual, or to public health or safety;
    • taking appropriate action in relation to suspected unlawful activity or serious misconduct;
    • locating a person reported as missing;
    • asserting a legal or equitable claim;
    • conducting an alternative dispute resolution process;
    • performing diplomatic or consular function – this permitted general situation only applies to agencies;
    • conduct specified Defence Force activities – this permitted general situation only applies to the Defence Force.
  2. Permitted Health Situation means the:
    • collection of health information to provide a health service;
    • collection of health information for certain research and other purposes;
    • use or disclosure of health information for certain research or other purposes;
    • use or disclosure of genetic information; and
    • disclosure of health information for a secondary purpose to a responsible person for an individual.
  3. Personal Information means:
    • information or an opinion about an identified individual, or an individual who is reasonably identifiable whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not and could include but is not limited to:
      • ‘sensitive information’ which includes information or opinion about an individual’s racial or ethnic origin, political opinion, religious beliefs, sexual orientation or criminal record, provided the information or opinion otherwise meets the definition of personal information;
      • Health information which is also ‘sensitive information’;
      • Credit information;
      • Employee record information (subject to some exemptions); and
      • Tax file number information.
  1. Privacy Act means Privacy Act 1988 (Cth);
  2. Sensitive Information means:
    • personal information that includes information or an opinion about an individual’s:
    • racial or ethnic origin;
    • political opinions or associations;
    • religious or philosophical beliefs;
    • trade union membership or associations;
    • sexual orientation or practices;
    • criminal record;
    • health or genetic information; and
    • some aspects of biometric information.
  3. You means a natural person.
  4. We, us, our means Glenskye Pty Ltd ACN 010 389 081 as trustee for the Gatton Real Estate Unit Trust trading as Gatton Real Estate (GRE);

INTERPRETATION

In this Privacy policy, unless the context otherwise requires:

  1. a reference to:
    • one gender includes the other genders;
    • the singular includes the plural and the plural includes the singular;
    • a person includes a natural person, partnership, body corporate, joint venture, association, government, authority, agency or other entity;
    • a party includes that party's executors, administrators, successors and permitted assigns;
    • a document is to that document as amended, novated or replaced from time to time;
    • “including" and similar expressions are not words of limitation;
    • a statute, regulation or provision of a statute or regulation ("Statutory Provision") includes:
      • that Statutory Provision as amended or re-enacted from time to time; and
      • a statute, regulation or provision enacted in replacement of that Statutory Provision, or if relevant, the predecessor to that statute, regulation or provision;
    • where a word or expression is given a particular meaning, other parts of speech and grammatical forms of that word or expression have a corres­ponding meaning;
    • if a party consists of more than one person, this Privacy Policy applies to them jointly and each of them severally;
    • headings are for convenience only and do not affect the interpretation or form part of this Privacy policy;
    • words defined in the Privacy Act have the same meaning in this Privacy Policy.

WHAT INFORMATION DO WE COLLECT ABOUT YOU?

You consent to the collection of Personal Information and Sensitive Information that you provide to us (either directly or indirectly) for use and disclosure by us in accordance with this Privacy Policy.

GRE will only collect Personal Information by lawful and fair means and where it is reasonably necessary for or directly related to one or more of our functions or activities. We will collect your Personal Information from you unless it is unreasonable or impracticable to do so.

We offer real estate services and collect information from individuals we deal with including prospective clients, prospective employees, current employees, referees and contractors, including those who visit our website.

  1. Prospective Clients or Clients

When you enquire about or use our services or when you become a client of GRE, a record is made which includes your personal information. The type of personal information that we collect will vary depending on the circumstances of collection and the kind of service that you request from us, but will typically include:

  • your name, e-mail, postal and residential address and other contact details;
  • your date of birth;
  • information about your employer or an organisation who you represent;
  • your employment or professional details;
  • photographs, film and/or recordings or any other digital representation;
  • your financial details including but not limited to:
    • names of banks or financial institutions;
    • bankruptcy information;
    • credit reporting information;
    • bank account information;
    • credit card details; and
    • insurance related information including but not limited to professional indemnity insurance details;
    • health information;
    • relationship information;
    • family information;
    • device information, such as which browser you use, your operating system language and how you use your device; and
    • your location or activity including IP address and geolocation data based on the GPS on your mobile device (when accessing our services), and whether you have accessed third party sites; and
  • any additional personal information you provide to us, or authorise us to collect, as part of your interaction with GRE.
  1. Prospective Employees or Current Employees

We collect personal information when recruiting personnel, such as your name, contact details, qualifications and work history. Generally, we will collect this information directly from you.

We may also collect personal information from third parties in ways which you would expect (for example, from recruitment agencies or referees you have nominated). Before offering you a position, we may collect additional details such as your tax file number and superannuation information and other information necessary to conduct background checks to determine your suitability for certain positions (for example, positions which involve working with children).

  1. Other individuals

GRE may collect personal information about other individuals who are not clients of GRE. This includes:

  • customers and members of the public who participate in events we are involved with;
  • individual service providers and contractors to GRE; and
  • other individuals who interact with GRE on a commercial basis.

The kinds of personal information we collect will depend on the capacity in which you are dealing with GRE. Generally, it would include your name, contact details, and information regarding our interactions and transactions with you.

If you are participating in an event we are managing or delivering, we may take images or audio-visual recordings which identify you.

In limited circumstances, GRE may collect information which is considered sensitive information. For example, if you are injured at an event promoted or delivered by GRE we may collect health information about you in an emergency or otherwise with your consent.

We may collect personal information about children (for example, when children participate in events we are involved with). Where children do not have sufficient maturity and understanding to make decisions about their personal information, we will require their parents or guardians to make decisions on their behalf.

You can always decline to give GRE any personal information we request, but that may mean we cannot provide you with some or all of the services you have requested. If you have any concerns about personal information we have requested, please let us know.

  1. Visitors to our websites

The way in which we handle the personal information of visitors to our websites is discussed below.

  • Why and how does GRE collect and use your personal information?
    • GRE generally collects personal information directly from you. We may collect and update your personal information over the phone, by email, via a form over the internet or social media, or in person.
    • GRE collects personal information reasonably necessary to carry out our business, to assess and manage our clients’ needs, and provide services including tenancy applications, property management, and residential sales and purchases;
    • we may also collect information to fulfil administrative functions associated with these services, for example billing, facilitating contracts and/or leases with you and/or third parties;
    • we may collect information to assist us in managing client relationships;
    • the purposes for which GRE usually collects and uses personal information depends on the nature of your interaction with us, but may include:
      1. responding to requests for information on properties;
      2. responding to requests for information for general inquiries;
      3. obtaining personal information from a tenancy database;
      4. managing, planning, advertising and administering programs, events, competitions and performances;
      5. researching, developing and expanding our facilities and services;
      6. informing you of our activities, events, facilities and services;
      7. recruitment processes (including for employment, volunteers, internships and work experience); and
      8. responding to enquires and complaints;
    • we may also collect personal information about you from other sources, for example:
      1. related entities;
      2. TICA (Australia’s largest tenancy database);
      3. Barclays MIS (Debt Collection);
      4. Equifax Australia;
      5. National Tenancy Database;
      6. Pexa; and
      7. third-party suppliers and contractors who assist us to operate our business;
    • GRE also collects and uses personal information for market research purposes and to innovate our delivery of products and services;
    • we may communicate with you over social media networks like X, Facebook, Instagram, YouTube, Snapchat and TikTok and we may collect your personal information during these interactions. These social media platforms have their own privacy policies that determine how your personal information will be dealt with if shared on their platform.
  • How does GRE interact with you via the internet?
    • You may visit our website www.gattonrealestate.com.au without identifying yourself. If you identify yourself (for example, by providing your contact details in an enquiry), any personal information you provide to GRE will be managed in accordance with this Privacy Policy;
    • GRE’s website may use cookies. A “cookie” is a small file stored on your computer’s browser, which assists in managing customised settings of the website and delivering content. We may collect certain information such as your device type, browser type, IP address, pages you have accessed on our websites and on third-party websites.;
    • you can use the settings in your browser to control how your browser deals with cookies. However, in doing so, you may be unable to access certain pages or content on our website; and
    • GRE’s websites may contain links to third-party websites. GRE is not responsible for the content or privacy practices of websites that are linked to our website.

HOW DO WE COLLECT & HOLD INFORMATION?

  1. Management and security of personal information
    • We mostly hold Personal Information electronically in our IT systems, devices, secure servers and databases, but we also may hold Personal Information in paper records.
    • We may store Personal Information physically or electronically with third party storage providers.
    • The security of your Personal Information is important to us and we take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure, including by:
      • maintaining appropriate document storage and data security policies;
      • maintaining computer and network security, for example, we use firewalls (security measures for the Internet) and other security systems such as user identifiers and passwords to control access to our computer systems;
      • taking reasonable steps so access to personal information is only provided to authorised persons;
      • password access rights to computerised records;
      • maintaining physical security over paper and electronic data stores, such as through locks and security systems at our premises.
    • Our employees are also required to respect the confidentiality of Personal Information.
    • Our website/s do not necessarily use encryption or other technologies to ensure the secure transmission of information via the internet. Users of our websites are encouraged to exercise care in sending personal information via the internet.
    • If we hold Personal Information we no longer need and the information is not contained in a Commonwealth record and we are not required by law to keep it, we will take reasonable steps to destroy or de-identify the Personal Information.

WHAT SENSITIVE INFORMATION DO WE COLLECT?

We may only collect Sensitive Information about you with your consent and which is reasonably necessary for one of our functions or activities unless the collection of such information without obtaining your consent is required or authorised by or under an Australian law or a court/tribunal order or a Permitted General Situation or Permitted Health Situation exits.

WHEN THE LAW AUTHORISES OR REQUIRES US TO COLLECT INFORMATION

We may collect Personal Information about you because we are required or authorised by an Australian law or court or tribunal order to do so. We will endeavour to tell you if this is the case and let you know the details of the law, court or tribunal order.

HOW DO WE USE OR DISCLOSE PERSONAL INFORMATION?

  1. If we need to use your Personal Information for purposes other than those outlined in this Privacy Policy (Secondary Purpose), we will obtain your consent unless:
    • you would reasonably expect us to use or disclose the information for the Secondary Purpose and if:
      • the information is Sensitive Information, it is directly related to the primary purpose; or
      • if it is not Sensitive Information, is it related to the primary purpose; or
      • we are required or authorised by or under an Australian law, tribunal or court order; or
      • a Permitted General Situation exists; or
      • a Permitted Health Situation exists; or
      • we reasonably believe that the use or disclosure of the information is reasonably necessary for one or more enforcement related activities conduct by or on behalf of an enforcement body.
    • Where we use or disclose Personal Information in relation to enforcement related activities, we will make a written note of the use or disclosure.
    • The Secondary Purpose does not apply to the use or disclosure by us for the purposes of direct marketing or government related identifiers.
  2. For clients

The purposes for which we may use and disclose your personal information will depend on the services we are providing you. For example, if you have engaged us to deliver a service (i.e. property management), we may disclose information about you to service providers where this is relevant to our services.

  1. For clients or participants at GRE events

If you are a client or participant in an GRE event, we may disclose your personal information to our clients and venues where this is reasonably necessary for, and relevant to, the delivery of the event.

We may use images or audio-visual recordings which identify you for promotional purposes where you would reasonably expect this to occur.

  1. Disclosure to contractors and other service providers

GRE may disclose information to third parties we engage with, in order to provide our services, including:

  • other real estate agents or agencies;
  • advisors including:
    • an accountant;
    • financial planner;
    • insurer;
    • broker;
    • financial institutions;
    • a lawyer;
  • contractors and service providers;
  • a relative;
  • an associate;
  • a referrer.

We may disclose information to third parties in order to provide our services to you, including for property management, sales and purchases of properties, customer satisfaction surveys, data processing or analysis, information technology services and support, website maintenance or development, printing, archiving, mail-outs, and market research.

Personal information may also be shared between related entities of GRE, located in Australia.

Third parties to whom we have disclosed your personal information may contact you directly to let you know they have collected your personal information and to give you information about their privacy policies.

We may combine personal information we collect from you with personal information we collect from third parties.

  1. Direct Marketing Disclosure

GRE may use or disclose your personal information for the purpose of informing you about our services, upcoming promotions and events, or other opportunities that may interest you. If you do not want to receive direct marketing communications, you can opt-out at any time by contacting us using the contact details below.

If you opt-out of receiving marketing material from us, GRE may still contact you in relation to its ongoing relationship with you.

We will not use or disclose Sensitive Information about you for the purposes of direct marketing unless you have consented to the use or disclosure of that information for that purpose.

If you do not wish to receive marketing material from us, please let us know by contacting us at sales@gattonrealestate.com.au or telephoning us on 07 5462 1311. If there is an opt-out function available, please use that function to opt-out. Where you request to opt-out of direct marketing, we will remove you from the marketing within a reasonable period of time after you request is received.

If you request information as to the source of your Personal Information, we will notify you of the source within a reasonable time frame unless it is impracticable or unreasonable to do so.

  1. Use and disclosure for administration and management

GRE will use and disclose personal information for a range of administrative, management and operational purposes. This includes:

  • facilitating tenancy applications;
  • facilitating sale / purchase contracts for properties;
  • facilitating property management;
  • responding to enquiries and complaints regarding our services;
  • administering billing, payments and debt recovery;
  • planning, managing, monitoring and evaluating our services;
  • quality improvement activities;
  • statistical analysis and reporting;
  • training staff, contractors and other workers;
  • risk management and management of legal liabilities and claims (for example, liaising with insurers and legal representatives);
  • obtaining advice from consultants and other professional advisers; and
  • responding to subpoenas and other legal orders and obligations.
  1. Other uses, disclosures & unsolicited Personal Information

We may use and disclose your personal information for other purposes explained at the time of collection or otherwise as set out in this Privacy Policy.

Where we receive Personal Information that we did not request, we will:

  • consider whether we could have collected the Personal Information in accordance with this Privacy Policy or the APP’s and if we could have, we will use and disclose the Personal Information in accordance with this Privacy Policy; or
  • if we determine that we could not have collected the Personal Information in accordance with this Privacy Policy or the APP’s and the information is not contained in a Commonwealth record, we will as soon as practicable destroy the information or ensure it is de-identified, provided it is lawful and reasonable to do so.

WHAT IF YOU DO NOT WANT TO PROVIDE US WITH YOUR PERSONAL INFORMATION

If we do not collect your personal information or you do not provide your personal information to us, we may not be able to:

  • provide you with information, a service or a product;
  • manage or administer property or tenancy services to you;
  • verify your identity;
  • progress your tenancy or property application; or
  • carry out one or more purposes for which we collect, use, hold and disclose personal information.

Anonymity: If it is lawful and practicable to do so, you may deal with us anonymously or by using a pseudonym. For example, when you make a general enquiry to us. However, in some cases where it is unlawful or impracticable for us to deal with you without you identifying yourself or if you are using a pseudonym and you do not identify yourself, we may not be able to deal with you.

HOW CAN YOU ACCESS OR SEEK CORRECTION OF YOUR PERSONAL INFORMATION?

You may request your personal information held by us. If you would like your personal information, please contact us using the details provided in this policy. You may be charged for the reasonable time and expense incurred in collating your personal information in response to your request.

If you notice errors in the information we hold, please let us know. We will take reasonable steps to ensure the personal information we collect, use or disclose is accurate, complete, relevant and up to date. If you believe your information requires updating because it may be out of date, incomplete, misleading or incorrect, you are entitled to request a correction of the information. We will take reasonable steps to correct the information after we receive your request.

If we previously disclosed your Personal Information to a third party and you require us to correct your Personal Information, we will take reasonable steps to provide such notification unless it is impracticable or unlawful to do so.

We may decline your request to access or correct your personal information in certain circumstances in accordance with the APP’s. If we do refuse your request:

  1. where it is reasonable, we will take steps available to us to provide access to your Personal Information in a way that meets our needs and yours if any steps are available; and/or
  2. we will provide you with a reason for our decision within a reasonable timeframe after you have made your request and provide you mechanisms to complain about the refusal and any other matters prescribed by regulations; and
  3. in the case of a request for correction, we will include a statement with your personal information about the requested correction; or
  4. if you request us to associate a statement noting the information is inaccurate, out of date, incomplete, irrelevant or misleading, we will take reasonable steps to associate the statement in such a way that will make it apparent to users of the information that is it out of date, inaccurate, incomplete, irrelevant or misleading.

NOTIFICATION OF THE COLLECTION OF PERSONAL INFORMATION

This Privacy Policy is to be read in conjunction with our Privacy Collection Notice.

  1. If we collect Personal Information from someone other than you or, in situations where you may not be aware that we have collected your Personal Information we will:
    • let you know that we have collected your Personal Information; and
    • how we collected your Personal Information;
    • let you know if the collection is required by or under an Australian law or court or tribunal order and will provide you with the details of the order and law that requires or authorises the collection;
    • let you know the purposes for which GRE collected the Personal Information;
    • let you know the consequents, if any, if all or some of the Personal Information is not collected by us;
    • let you know who we may disclose your Personal Information to;
    • let you know about this Privacy Policy so you know how to:
      • access your Personal Information and seek a correction if necessary;
      • complain about a breach of the APP’s and how we will deal with such complaints;
    • let you know whether we are likely to disclose your Personal Information to overseas recipients; and
    • if we are likely to disclose your Personal Information to overseas recipients, the countries in which those recipients are likely to be located if it is practicable for us to specify those countries.

COMPLAINTS ABOUT PERSONAL INFORMATION & HOW WE WILL DEAL WITH COMPLAINTS

You may contact GRE at any time if you have any questions or concerns about this Privacy Policy or about the way in which your personal information has been handled.

You may make a complaint about privacy to the Privacy Officer at the contact details set out below.

The Privacy Officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint. We will generally respond to your complaint within 14 days.

If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within 7 days and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.

In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.

If you are not satisfied with our response to your complaint, or you consider that GRE may have breached the APP’s or the Privacy Act, a complaint may be made to the Office of the Australian Information Commissioner (OAIC). The OAIC can be contacted by telephone on 1300 363 992 or by using the contact details on the OAIC website.

WILL WE DISCLOSE YOUR PERSONAL INFORMATION TO OVERSEAS RECIPIENTS

We may disclose Personal Information about you to overseas recipients, for instance, when storing Personal Information with technology service providers which are situated outside Australia. We will endeavour to only disclose Personal Information to overseas service providers when it is necessary for the services they provide to us.

  1. Where we disclose your Personal information, we will take reasonable steps to ensure the overseas recipient does not breach the APP’s in relation to this information unless:
    • We reasonably believe the recipient is subject to a law, or binding scheme, that has the effect of protecting the information in a way that is overall, similar to the way in which the APP protect the information; and
    • There are steps you can access to take action to enforce that protection of the law or binding scheme or:
      • Where we expressly inform you that if you consent to the disclosure, the above protection does not apply; and
      • After you have been informed of this exception, you consent to the disclosure; or
    • The disclosure of the information is require or authorised by or under an Australian law, tribunal or court order; or
    • a Permitted General Situation exists in relation to the disclosure of the information by us.

The countries in which these overseas service providers are likely to be located is:

  1. United States of America;
  2. United Kingdom;
  3. Asia Pacific;
  4. Germany;
  5. Japan; and

HOW WILL WE USE YOUR GOVERNMENT RELATED IDENTIFIERS

  1. We will not disclose your government related identifiers (for example, Medicare number, drivers license or Australian Passport number) unless:
    • the use or disclosure of the identifier is reasonably necessary for the organisation to verify your identity for our activities or functions;
    • the use or disclosure of the identifier is reasonably necessary to fulfil our obligations to an agency, State or Territory authority or is required or authorised by or under an Australian law, tribunal or court;
    • a Permitted General Situation exists in relation to the use or disclosure of the identifier (other than for legal or equitable claims or alternate dispute resolution); or
    • the use or disclosure of the identifier is reasonably necessary for one or more enforcement related activities conduct by or on behalf of an enforcement body or prescribed by regulations.

  2. Who we share your Personal Information with
    • The purposes for which we may use and disclose your personal information will depend on the services we are providing you.
